End User License Agreement

This is the agreement you accept by installing or using PCAPNG Analyzer, on the Free tier or with a Pro subscription. See also the Refund & Support Policy.

This End User License Agreement (“Agreement”) is between you and Stuart Mathieson (“Licensor”) and governs your use of the PCAPNG Analyzer software, including any documentation that accompanies it (together, the “Software”). By installing or using the Software you agree to this Agreement. If you do not agree, do not install or use the Software.

  1. Free Tier and Pro. The Software is distributed as a single application that runs in one of two modes. The “Free Tier” is available at no charge and needs no license key. “Pro” unlocks additional features and higher limits, described on the pricing page, when a valid license key from an active Pro subscription is entered. Except where a section says it applies only to Pro, this Agreement applies to both.
  2. License Grant. Licensor grants you a non-exclusive, non-transferable license to install and use the Software on devices you own or control, for your own internal purposes, including the internal business purposes of your organisation. For Pro, each license key unlocks Pro features on one instance of the Software at a time, and only while the associated subscription is active and paid, or in its free trial.
  3. Pro Subscription. Pro is sold as a subscription costing £49.99 per year for each instance. The subscription is billed annually in advance through Licensor's payment provider, Stripe, and renews automatically each year until cancelled. Subscriptions bought before 5 October 2026 continue at the price and billing period they were bought at. A new subscription starts with a 14-day free trial: a payment card is taken at checkout but not charged, and the first annual payment is taken when the trial ends unless you cancel before then. Cancelling during the trial means you are not charged. You may cancel at any time through the customer billing portal or by contacting [email protected]; cancellation stops future renewals, and Pro remains available until the end of the period already paid for. When a subscription ends, lapses or is refunded, the Software reverts to the Free Tier. Your captures, analysis results and settings are not deleted, and this Agreement continues to govern your use of the Free Tier.
  4. Restrictions. You may not: (a) redistribute, sell, rent, lease, sublicense, or otherwise transfer the Software or your license key to any third party; (b) reverse engineer, decompile, or disassemble the Software except to the extent applicable law expressly permits; (c) remove or alter any proprietary notices in the Software; (d) use the Software to provide a commercial hosted or bureau service to third parties; or (e) circumvent or tamper with license validation to unlock Pro features without an active subscription.
  5. Ownership. The Software is licensed, not sold. Licensor retains all right, title, and interest in and to the Software.
  6. Third-Party Components. The Software incorporates open-source components listed in the accompanying THIRD-PARTY-NOTICES file. Those components are governed by their own license terms, which apply to those components in place of this Agreement.
  7. Local Processing; No Data Collection. The Software processes capture files on the server or device where you run it and does not transmit your files or their contents to Licensor or any third party. It makes only two kinds of network request:
    1. if you enter a license key, the Software sends that key and a product/version identifier to Licensor's license-verification provider (keygen.sh) to validate it, both when entered and periodically thereafter, solely to confirm the key remains valid; the Free Tier used without a license key makes no such request;
    2. unless you turn it off, the Software asks GitHub (api.github.com) about once a day for the latest published version, so it can tell you when an update is available. That request contains no license key, version, capture data or information about your installation, although GitHub, like any website, receives the requesting IP address. It can be turned off in the Software's settings or with the UPDATE_CHECK=0 setting.
    No capture data or analysis results are included in any transmission.
  8. Updates. Licensor may publish updated versions of the Software, currently as Docker images on Docker Hub and as downloads on GitHub, but is not obligated to provide updates, upgrades, or support.
  9. Refunds. Refund eligibility and process for Pro subscriptions are set out in Licensor's Refund & Support Policy, available on this website. Where a refund is granted, Licensor may deactivate the license key associated with the refunded purchase. A refund is offered as a customer-service matter and is not an admission that the Software is defective or that Licensor is liable for any loss (see Sections 10-11).
  10. Disclaimer of Warranty. THE SOFTWARE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. NETWORK CAPTURE ANALYSIS RESULTS ARE PROVIDED FOR INFORMATIONAL PURPOSES ONLY AND MAY BE INCOMPLETE OR INACCURATE; DO NOT RELY ON THEM AS THE SOLE BASIS FOR ANY SECURITY, LEGAL, OR OPERATIONAL DECISION.
  11. Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LICENSOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR BUSINESS, ARISING OUT OF OR RELATING TO THIS AGREEMENT OR THE SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. LICENSOR'S TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE SUBSCRIPTION FEES YOU PAID LICENSOR IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. Nothing in this Agreement excludes or limits liability that cannot be excluded or limited under applicable law, including any non-excludable statutory consumer guarantees in your jurisdiction.
  12. Termination. This Agreement terminates automatically if you breach it. On termination you must stop using and delete all copies of the Software. The end of a Pro subscription is not a termination of this Agreement; see Section 3.
  13. Governing Law. This Agreement is governed by the laws of the jurisdiction in which Licensor resides, without regard to conflict of laws principles, except where the mandatory consumer law of your place of residence applies instead.
